  • L1B->L1A->EB1C Possible?

    Hi All,

    I'm hoping to get a second opinion on here.

    Background of myself: Entered the US on L1B status couple years ago, and changed to L1A last year as Functional Manager (no direct reports) due to a new position. Have been trying to understand if I could apply for greencard through the EB1C process.

    My company's lawyer told me basically the chance is very slim, becoz of the fact that I came on L1B as "specialized expert" (also no direct reports), which is the complete opposite of "Manager/Executive" per the requirement of EB1C.

    Can anyone share if you have similar situation and experience, and is it true that even with my current L1A status it's very unlikely I can get approved through EB1C?

    Any suggestions would be appreciated.

    Chances are virtually nil. EB1C eligibility criteria clearly say that you should have held an executive role in atleast 1 out of 3 yrs. prior to entering the US. The visa category you use to enter the US is immaterial. And having or not having direct reportees is also not strongly relevant per se. (USCIS clearly states that the role should have a strategic aspect, and just managing a bunch of people does not qualify one for this category.) From the info. you provided it appears that you do not meet this criterion.
