L1A Extension denied - New L1A blanket interview

  • L1A Extension denied - New L1A blanket interview

    Hello All,

    I am following this forum for a long time and its very much helpful.

    I am in a situation where I need you guys to help and support.

    I have been working for a company YYYY in the US for the past 3 years in L1A(blanket) in “managerial capacity”.

    My company filed the first L1A extension in the month of May and we got RFE in the month of July.

    We replied back with all the requested documents in the month of September. But my extension got denied in the month of October.

    Now we filed a new L1A blanket petition around scheduled an interview in Chennai.

    Followings are questions:
    1. Will my extension denial has any impact on the new petition?
    2. Whether the VO has complete details of my denial of reasons/notice?
    3. Will there be any questions by VO related to my extension denial in the interview?
    4. What could I answer if the VO asks about my denial reasons?
    5. Since its very short time frame for the new petition interview, my company suggested showcasing as currently, I am working in India with US payroll. Will that legally possible scenario?
    Please help me with this.

    No, but if your role/responsibilities are not changing, then the result won't change either.

    If your extension is denied, then you should not be on US payroll at all.

      I have done with my new L1A petition and it’s approved.
      The VO didn’t ask anything about my previous visa denial.
      She just treated like a first-time petition.
      Followings are the details
      Me: Good morning
      VO: Good morning. Which company you are working for and for which company you will be working in the US?
      Me: xxx in India and xxx in the US
      VO: how long you have been working for xxx company?
      Me: 5 years
      VO: what’s your work location in the US?
      Me: I will be working from my headquarters which is located in xxx city, xxx State
      VO: what’s you designation
      Me: yyy
      VO: How many direct repotees?
      Me: 5
      VO: What’s their designation?
      Me: 1 Lead, 2 lead Engineers, 1 SSE and 1 SE
      VO: how many indirect repotees?
      Me: 7
      VO: what’s your salary in the US?
      Me: xxx USD
      VO: What’s the designation of your supervisor?
      Me: yyyy
      VO: What’s the designation of his supervisor?
      Me: yyyy
      She asked once again about my supervisor’s designation… It looks like she is feeding the details in her system.
      VO: what are your roles and responsibilities?
      Me: explained in detail

      No more questions for 2 minutes and she was typing something in her system. And finally, she mentioned “your visa has been approved” J
      No questions to my spouse and Son.
      This forum helped me a lot to prepare for the interview.

            rithu0706 - what all info you provided in your new I129s for your previous US visit? Did you provide Entry and Exit dates which should be in past 3yrs?
