I entered US on H-4 (dependent) visa in 2012 valid until Sept 2015 and got my change of status done in 2013 from H-4 (dependent) visa to F-1 (student) visa, in order to study in one of the universities in Charlotte, NC. Please note, post COS change, I never traveled out of the country and still have a valid H-4(dependent) visa stamped on my passport.
I am planning to visit India in June 2015 due to urgent personal reasons. As, my studies end in May 2015, I cannot go for F-1 stamping. Also, due to this urgent travel I need to let go away the OPT job opportunity, and won’t apply for OPT EAD card.
Please suggest whether I can travel back to US on existing valid H-4(dependent) visa or do I need to apply for a fresh H-4 visa stamping in India. Kindly note, my spouse is on H1-b valid until Sept 2015 and will be soon applying for an H1-b visa extension.
