  • Chances of getting TN Visa

    I am a Canadian citizen living in Toronto, Canada from 7 years. I am an UNIX system administrator by profession and got 4 years of real time experience in Toronto, Canada with different employers. I am a mechanical engineering graduate from India and obtained couple of UNIX related certifications from local colleges in Toronto, Canada. Also I have couple of Solaris (UNIX) certifications from Sun Microsystems, USA. Now I am trying to get into a job in US. I am receiving calls from recruiters and hope to find a job soon in USA. Now the real issue is with TN Visa. The recruiters are ready to send the required letters/documents for my TN Visa. But on of my friend says that I may or may not get the TN visa as my bachelor’s degree (16 years) and professional designation are not related. In the sense I may get a letter as “UNIX System Administrator” or “Linux System Administrator” or “System Analyst” or “Unix Specialist” and where as my graduation is from mechanical engineering.

    Please let me know usually what are the chances of getting TN visa for this kind of situations. I appreciate your suggestions so that I can well equip my self with the necessary documents and preparation. Give me as many clues as possible. I want to visit the office near Niagara Falls, ON, CANADA when I am ready.

    You must meet the following criteria and there is a list of professions listed there... you need to call ahead at the port of entry to US to see how long of time should you allow for processing as you are at the mercy of the border guard...

    So dress nicely, be polite at all times; even if the border guard is an **** - which they will tend to be due to power trips/ego and also it's probably part of their job description - to make life a living hell for foreigners. Personally, I've been fortunate that I caught the border guards on good days. I tend to choose males (they don't have PMS to contend with and see how they treat others first before I get in line (airports)!

    Requirements for TN-1
    The applicant must be a Canadian citizen.

    The applicant must provide evidence that the intended U.S. business activity and the applicant qualify under Schedule 2 of NAFTA. A list of professionals who qualify is attached as Exhibit A.
    The applicant must provide proof of possession of a license to practice his/her profession in the U.S., if one is necessary in the U.S. state where employment is located.
    The applicant must provide documentation of remuneration arrangements with U.S. employer.
    The applicant must show the U.S. employment will be temporary.
    There can be no strike or lockout from a labor dispute in applicant’s job at the worksite.
