My brother, mother and Minor niece applied for a B1/B2 visa .. mom was a renewal and she got approved where as My brother along with my niece got denied 214(b).
We reapplied for my Niece with explanation that my brother is divorced and has sole custody of my niece ever since she was 3 years old .. she is 10 now.
I would like my niece to come to the US for her summer vacation along with my mother (she has an approved visa).. today we received a letter from US Embassy requesting both the parents to appear at the embassy 221(g)..
Since my brother is divorced can he just appear with my niece and have an NOC from his ex wife along with divorce papers? also a certificate showing that my mother is indeed a legal guardian for my niece?
Has anyone experienced this issue before? would be great help if you can recommend some options?
