  • Is using Emergency Medicaid in US, subject for denial for B1/B2 visa renewal?

    Hello
During my last visit to the USA in 2020, when the COVID crisis started, I had to extend my visa stay due to airport closures.
I had a medical emergency and I had to use emergency Medicaid insurance to cover my medical bills in the emergency hospital. I am planning to renew my expired B1/B2 visitor visa as I plan to visit my brother who lives in the USA again. Does using emergency Medicaid insurance in the past affect my eligibility for B1/B2 visa renewal ? Is it a subject for public charge and denial for my visa renewal application ?

In my interview for visa renewal they asked me why did I over stay my 6 months, I mentioned COVID and medical emergency. Officer asked for medical bill from the hospital showing that I paid for my medical services.

I have a medical bill showing zero balance from the hospital but paid by Medicaid, but if submit it would I get visa denial ?

    Please Help !!
    Thank you.

I am sure they already have systems in place to know about all your history. You submit medical bills or not doesn't matter.

Since they specifically asked for the medical bills, you should not lie or hide the truth, but share those documents. Hiding the truth or telling lie, will ban all your future visas for years.

Using medicaid under emergency, it not a problem - it was real emergency. They do understand that & thats what is the purpose of Medicaid. Explain them the real scenario & reason of you using it. Worst part, they might probably deny your B1/B2, but you'll still be safe for any other type of visas in future.

Use of Emergency Medicaid, or even regular Medicaid, is not considered for determining whether you are inadmissible for being likely to become a public charge. However, the officer can always deny you for immigrant intent if they don't like anything in your history.

Here are some points to consider:

Public Charge Concerns: The U.S. government may assess whether an applicant is likely to become a public charge, meaning relying on government assistance for assistance. Emergency Medicaid is generally considered a form of emergency medical assistance and may not be a significant factor in public charge considerations. However, it is essential to consult with an immigration attorney to receive individualized advice based on your specific situation.

Medical bills paid by Medicaid: If you submit a medical bill with a zero balance but paid by Medicaid, it is important to be honest and transparent during the visa renewal process. Provide all relevant documents and information as requested during your interview.

Documentary evidence: Having documents to support your claim is important. If you have a medical bill that shows you paid for medical services, you should submit it as part of your application. However, be prepared to explain the circumstances surrounding the emergency and use of Medicaid.

Consult an Immigration Attorney: Immigration laws and policies can be complex and subject to change. For individualized advice and guidance, you should consult an immigration attorney. They can provide insights into the specific implications of emergency use of Medicaid in your case and how it may affect your visa extension. doodle baseball

I can understand your concern about how using emergency Medicaid might affect your B1/B2 visa renewal. Generally, using emergency Medicaid should not automatically disqualify you from renewing your visa.

However, visa decisions are made on a case-by-case basis, so it's essential to provide all relevant information and documentation, including your medical bill showing a zero balance paid by Medicaid.
