  • Embassy claims my mom overstayed

    Any help will be greatly appreciated,

    My parents had come to US on a visiting visa in Sept 2003. They had a one year visa and at the port of entry the i-94 was stamped to be valid till May-28-2004. They returned to India from US on May-14-2004.
    Yesterday my parents applied for a visa in Chennai and they rejected it saying they overstayed in US when they visited last time. Embassy oficers say that the date on I-94 will never be more than 6 months and you stayed 7 months. Where as actually the date on the I-94 was 7 months. They are saying that they need a letter from Dept of Homeland Security that my parents didnt overstay.
    Anybody had similar problems.?? please advice me on how to solve this. I dont have a copy of the I-94 with me

      We dont have a copy of the I-94. I tried to call the customer service of department of homeland security. They asked me to talk to the arrival- departure section of the Airport of departure. I talked to them and after lot of effort they were able to find out the i-94 card and they found that my mom has not over stayed. But they are not willing to give a copy of the I-94 or a letter saying that she hasnt overstayed. They say that they will tell that to the embassy if the embassy calls them directly. Please advice me on how to proceed.

          I guess you can try and call again to the customer service. Ask them if the embassy would like to enquire on this case, how can they get to the specific I-94 you are talking about. And then check the US consulate if that information will be sufficient for them to verify your claims.

          Alternatively also try and check if they will provide a copy directly to the US consulate concerned.
