    HI,
    My father was given a 3 month valid I-94 when he arrived here. Now we would like to apply for an extension of his stay. Currently, his I-94 expires on Nov 4, 2006. I hardly have 40 days left now.
    Can i apply for the extension by filing the I-539?
    What happens if it is denied because i am worried his 10 yr multiple visa might be jeopardised beacuse of this action
    Iread in this website that you should stay for a minimum of 3 months in order to apply for this extension? is this true? because his I-94 is valid only for 3 months and i cant wait till 3 months and file? please advice
    If denied, is there any time within which he has to leave the US?
    Any help and suggestions are greatly appreciated .

    Per law, visa gets cancelled once extension is rejected but there are some people who says it is not...

    extension needs to be applied 4-6 weeks before I-94 expires.

      Similar issue of Visitor visa Extension

      Seeking advice......

      My parents and sister are in US and their I-94 validity period is for 3 months with 10 year multi-entry Visa. They have return tickets for the last week of Jan and I-94 is valid only till mid of December.

      My questions are:
      1) If I file for an extension, what are the better reasons for requesting extension?
      2) Should I file 4 to 6 weeks before?
      3) If the extension is denied before the end of Jan what measures I can take?
      4) If the extension is denied after they leave the country i.e after the end of Jan, can I write them a letter to disregard the extension application requesting not to process it?

      In any case they will have to carry the copy of extension application to submit it with the expired I-94, right?

      All help is appreciated!

        My Own Extension Got Approved recently

        I arrived here November 2005 and got a six month stamp till May 2006. April 2006 I applied for extension and July 2006, USCIS asked for documents. I just got my approval last September 2006. They gave me another six months ending November 2006.

        My advise is, apply as early as possible. USCIS takes a long time before they respond. If by your I-94 expiration, you dont hav ethe results yet of your extension, leave the US and withdraw the extension request. Don't jeopardize your status.
