  • Visitor Visa Extension

    Hai,

    We have applied for B1/B2 Visa Extension for my mom,her actual I-94 Expires on Oct 28 2008. we asked for Extension till Feb 11 2009.
    But we actually booked an air ticket to Feb 11 2009 before entering in to the country.

    while filing the documents, they asked for a photocopy of Air-Ticket.
    we also send all the documents.
    now we are like wondering whether the USCIS may think that we have planned to make her stay in the contry before entering U.S.A

    So please help us, will it be a problem ?

    An astute person will see that you always intended for her to overstay her initial I-94. You better believe it will be a problem. She should have her visa voided for the fraudulent actions.

    That was just plain stupid to plan to violate the PRIVILEDGE of VISITING the US. Shall I guess that it was due to pregnancy?

    If you cannot abide by the laws of the US, you should return to your home country.

      yes, she was here for the delivery of my baby.

      if it is denied, is she has to go on the same day itself?
      or will they give like 30 day period to go out of the country ?
      please help.

        She needs to leave ASAP. This is your only hope of countering the fact you booked tickets PLANNING to ask for an extension PRIOR to her arrival in the US. Do you not understand that this is a violation of US immigration rules? An extension is for unexpected events that occur after arrival in the US. THe birth of your child DOES NOT QUALIFY. YOU HAVE DELIBERATELY VIOLATED US IMMIGRATION LAW.

        If you needed her at your delivery, you should have gone to HER home rather than bringing her to yours.

        Based on these actions, she could lose her visa and have difficulty acquiring another. Do you NOT understand that this is a big issue? She needs to leave NOW!

          Hai,
          But we haven't mentioned as she came here for delivery.
          In Extension Letter, we have mentioned like she came here for tourism,she is elderly to travel a long time up and down, and she haven't seen
          West Coast..... and she has her spouse and other family members in India.


          The only thing we worry about is her Ticket Booked on Feb 11 2009
          please help.

              Change the ticket back, it should not be more than $100-150.

              Can you really afford to have her flagged as a potential immigrant and lose her visa?

                  You are NOT listening... it does not matter... there is not a question of IF... the question is whether you are going to do what is best to your mother and send her back before she gets in any more trouble and goes through perhaps even deportation procedures...

                    Don't worry about me. I'm just frustrated with the stock market and politics lately. I am also frustrated that it seems like lately there are far too many questions about extending visas even though there have been numerous postings about the problems that result. This OP seems particularly clueless!

                    I am beginning to wonder if posters ever bother to read the archives. Too many act like their very typical situation is somehow special. Unfortunately, they refuse to acknowledge that their actions affect the ability of their countrymen to obtain visas in the future. (On a happier note, some of my family members who had been having problems getting visas in their home country due to the overstays finally got their visas and 10 year ones at that!! Hurray!! They will be here for Christmas. Now I must plan a traditional American holiday feast. They will definitely not extend their stays. If the mom and dad demonstrate they are responsible, perhaps brother will be able to get a visa in a couple of years.)

                    I saw one proposal that any country that had over 2% overstays would be eliminated from participation in certain visa programs. It is a draconian measure! If the problem of illegals in the US remains and actions such as those are implemented, it won't matter whether the illegal status results from unauthorized entry or overstay.

                        please help me.
                        we might take a desicion if this is possible.

                        My mom's I-94 Expires on Oct 28, but we actually applied for an extension till Feb 11 2009, she had her Ticket to fly back on Feb 11 2009 too( which is a problem for her extension.)

                        If she leaves U.S before her original I-94 Expires ie before Oct 28 2008,
                        will her 10 year visa will get cancelled ?
                        will she get any other problems during her next visit to U.S ?

                        1) if she has returned to her home country Before her original I-94 Expires, if the Extended visa got approved will she faces any problem during her next visit.

                        2) if she has returned to her home country Before her original I-94 Expires, if the Extended visa got Denied will she faces any problem during her next visit.

                        Please help me.

                          She will face problems if she stays past her I-94 original expiration date. Send her home, she can come back in 6 months.

                          And just so you know, we are not trying to be mean to you, we wan't you to enjoy having your mother come for several visits over the years and not lose her visitor visa.
