Atlas America insurance for my brother

I'm considering purchasing your Atlas America policy for my brother. He has been in the states for 6 months and is applying for a spouse visa. He has been given a restricted ssn which requires authorization to work - I believe he is currently defined as a lawful alien. Although he does not residency status yet, he hopes to get it in the next few month. He has a bank account and permanent address in the US with his wife. He doesn't really have an address in uk.

Any advice is appreciated.

Your brother home country is USA. Atlas america plan is not available to US resident.

This is the problem. He isn't an 'official resident yet'. He has no visa or green card and his SSN is restricted. I'm so confused, I have spoken to so many different people all who tell me something different.

If you can help me get to the bottom of this I'd be most grateful and will buy a policy!

Please note that resident definition is different from the point of immigration (USCIS), tax (IRS) and for insurance.

What is his current legal status? Please be very specific regarding this as I understand the immigration very well.

He entered on a waiver visa (90 days) but ended up getting married and staying. His has a lawyer working on his behalf to get a spouse visa - he has a second interview in a few weeks. The same lawyer got him the ssn (requiring uscis authorization) and 12 month work permit.

So at the moment he isn't covered by a visa but I believe he is a lawful alien?
