H1B, H4 Visa

I got my VISA rejected under 221(g) last year(Dec 2006)with similar letter as posted by Geetha below, from Chennai Consulate. I got case status update E-mail from USCIS stating the following:

"Current Status: Case was shipped to the Department of State for visa processing.

 "On June 5, 2007, we shipped this approved or
re-affirmed case to the Department of State for visa processing. For more information, please
contact them directly".

This happened in June first week, but till now, did not got any further information neither from USCIS nor from Chennai Consulate.

Does anyone got such status after 221(g) refusal.Please shar your experience, if so.

Attended interview on 4th Dec morning 9 am, came out of the consulate at 3 pm.

They gave me blur 221(g) form requesting for the petitioners doc.

1. A copy of the petition with all supp docs as filed with USCIS
2. employment contract between me and petitioner
3. petitioner's IT return
4. notarized list of all the petitioners employees
5. State unemployment wage report for the past 3 quarters
6. A copy of the contract between employer and the client
7. Letter from the personel dept stating a job for us in USA.
8. the applicant's itinery of the services, including company names and addresses.


I didnot understand the No : 8.
Can anybody suggest me waht exactly is this ?

And also i want to know whether i should the passport or not. For me they did not write aanything about the passport. but in page 2 of 221g, it is checked marked (printed) send passport and 221(g) form.

Please help.

Can someone share experience on how long it took to get the passport back in hand after VISA appointment /approval?

hii..
i attended visa h1b interview in chennai..
he told me i will get passport with in a week.is it implies that my got approved na..in vfs site the passport status is not been reveived from consulate..

can any one tell me..what might be the reason..

can somebody pleaseee tel me how long will it take for administrative processing to complete as my case is the same & what are the chances of getting the visa after the processing.

Anybody who faced the same situation pleaseee help mee in this.

I got 221g blue



Your application requires Additional Administrative processing before a final decision can be made.This office will contact you once this administrative processing is complete.



Visa officer taken DS156 ,DS157 me and my wife,I797 ,Receipt of hdfc,Company Tax Returns 2005 and 2006,Quarterly Tax Returns 2007,Bank Statements,Employee list.



Visa officer lastly told i will get a call from consulate.

Generally how many days will take to get a call from consulate is it email or phone ?



Any persons from this group got a call ?

Below is the letter which i have received from the consulate after submitting the necessary documents as i have got a query. Within 2 days they have sent this letter to me. Can anybody please tell me whether my case is still pending or it has been rejected as they have not returned back any of my documents. Any body who faced the same situation pleaseeeeeeee helpp me.

"Based on the documents you have submitted to us and the information elicited in your interview with an American Consular officer, we are not able to issue you an H-1 B temporary work visa, because:

Your petitioner does not appear to be either able or willing to provide qualifying employment in the United States in accordance with appropriate laws & regulations.

In accordance with United States law and department of state guidelines, action on your case has been suspended, and the I-129 petition for a Non-Immigrant worker filed on your behalf will be returned to the United States Citizenship and Immigration Services with a memorandum of facts of your case as presented to us at the time of interview. The U.S. consulate is no longer handling your case, and will be unable to give you any information on the status of your petition.

For your information your visa was refused today under section 221(g) of the Immigration and Nationality Act. Essentially, this section states that a visa cannot be issued to anyone whose application does not appear to the consular officer to meet the requirements on the INA or the regulations thereunder."

Me:I told two client names

Vo:Can you give the Client letter
Me :I am going for in house project (I thought she is asking about other clients)

Vo:U said about the clients
Me:I am doing in house

Vo:Can you Show me mark list
Me :Yes

Vo took the blue paper and ticked some questions
I saw it ,after i came side,she asked me the letter from client :( ,which i told those three client names),she asked other documents

My employeer send me all the papers,but regarding client he explained that i am doing inhouse project.I posted those documents on 26 th Sep.But i did not get any result from Consulate.Please tell me whether i will get visa or not
