EB1 QUESTION
I have a question about EAD/AP.

I applied (with my wife) for an EB1-A and the I-140 was approved with a priority date of Sep 2018.

We’re both on O1s, so have been waiting for our priority date to become current before applying for the I-485. But it’s been backlogged since we were approved. The issue is that both our O1s expire in June/July 2020, and we’d prefer not to apply for new visas, so are thinking of sending in our I-485s to get our EAD/AP.

The question is: Can we send in our I-485 before our date becomes current? Will they issue the EAD/AP in good time, or will they hold off until the dates becomes current? What’s the wait time on the EAD/AP right now - curious how long we won’t be able to leave the country?

My understanding is that it’s slower to cross the border on an EAD/AP card and that you need to go into secondary, or at least can’t use Global Entry. Is that right? We travel back and forth to Canada for work a lot, so want to avoid being on the EAD/AP for a prolonged period of time if it slows us at the border.

Also, is there a benefit to sending in the I-485 now? So that we could get in line do our interview earlier, and then be ready to receive the GC when our dates finally become current?

Also, I’m wondering about our medicals in case the dates remain backlogged. I know they’re only current for a year. So my question is, when do they need to be current for - when they’re doing the biometrics, interviewing, or issuing the GC?

Thank you!
