EB2 - Cross Changeability AOS Interview

Hello All,

I have been a silent audience of this forum and have benefited a lot myself to get things clarified and to know the outcome of a situation.

I would like to share my experience here hoping that it may be of use to someone.

My timelines are as below:

EB2 - ROW *(Cross Chargeability)

Feb 2018 - i485 Receipt Date
Mar 2018 - i765 - Biometrics
May 2018 - EAD / AP Approved
Oct 2018 - i 140 Approved
Oct 2018 - Form i485 Transferred to another USCIS Office
Feb 2019 - i693 Courtesy Letter

Mar 15 2019 - Case Ready to Schedule
Mar 18 2019 - Interview was scheduled
Mar 22 2019 - Received Interview Letter by mail
Apr 19 2019 - AOS Interview
Apr 23 2019 - New Card Is Being Produced
Apr 24 2019 - Case Was Approved
Apr 26 2019 - Card Was mailed
May 02 2019 - Card Received in Mail

My interview was held in the San Jose USCIS office scheduled at 7:45Am.We were called inside by 8:20Am and we came out around 9:10 Am. The IO was a calm person, took us to his office and asked us to turn off the mobiles first, took the oath and then asked us to take our seats. Since my wife was the primary applicant he asked for all of her originals and asked us to place everything on the table. He then asked if there were some packets for him which he was referring to the medical reports. He asked for the current paystubs, original birth certificates, W2's, EAD's( both old & new)kids original birth certificate (if US born). He then started to ask the regular yes-no questions to both of us and he said that he has everything needed. He then checked the visa bulletin and told us that the current processing date is as on Apr 2009 and that we may have to wait.

I then informed him that this case is under cross chargeability as I was born in the UAE and is in the ROW queue and he immediately started to look into the case again and mentioned why you didn’t tell that first. He then told us that visa should not be a problem and asked for all my original documents. Fortunately, I had the translated version of my bc and also an affidavit from my dad due to a name change in the past. I made a mistake by voluntarily mentioning about the name change or he would not have noticed it and I also submitted my old expired passports mentioning the name change and my school certificates showing the right name. However, the IO was a little hesitant to accept them and said that you may need to provide additional evidence to support this proof. He said that you may have to get a letter from the Indian embassy stating that names on both the records are the same person. We were then told that he would have to check with his supervisor to take a decision on this and an update can be expected in another 90 days. It was a heavy stress after the interview....

Until things went well and 2 days later we received an update "New Card in Production". Like everyone tells "Patience is the Key". But the most important tip to everyone attending the interview is “Do not volunteer and give out any info unless asked for it".
