EAD Extension only without AP ... Need Help
My employer based EB1 C petition was approved on 10/26/18 and AOS interview is scheduled on 2/11/19. My EAD and Advance Payrole expires on May 2 2019.
We are planning a personal trip to India in February right after the AOS interview, I will be staying in India for a couple of weeks and return early March - well before my EAD/AP expires but my wife and daughter are planning to stay until mid-April which is only a couple of weeks before the EAD/AP expires.
Questions:
- Can I extend my EAD and AP upon my return to the US in March and while my wife and daughter are in India?
Alternatively...
- Can I just extend my EAD now (I believe EAD is auto-extension) and apply for advance payrole separately once my wife and daughter returns in April?
Any thoughts. insights is greatly appreciated.
