I have a bit of a strange situation here.
My spouse is Mexican (I am American) and we got married last year while visiting in the U.S. then went back to China (where we both lived at the time). We have since come back to Mexico/US. She is currently staying with me in the U.S. With a border crossing card (B1/B2) visa, and a travel permit (I-94) valid for 6 Months, so no need for a K-1 visa, I think?
While living in China I wasn't making that much money so I didn't file a tax return in the U.S. from 2010 to 2012. I have a friend who is willing to be a joint sponsor.
Do I need to file my own i-864, or will my friend's suffice?
If I do need to file my own i-864 how can I deal with my situation?
I am currently employed (have been for 6 months) and making well above the poverty level.
Please help, I'm really stressed out about this form.
