  • Ray b and all other Sr, please help: I485 DENIED when wife withdrew application!

Please assist in advising what our next step should be. I married my American wife on March 20, 2012 and I also got a work permit right away and have a great job teaching at the Oakland Unified School District.

My wife missed one of our appointments while visiting family in Miami last year and we had to petition for the San Francisco office to allow us another interview.

We went into the interview office last week on the 21st of April, 2014. My wife was very nervous and when they told her that my answers and her answers (what did we have for dinner last night, who lives in the home with us, where we met, what date we met, what was the last thing I bought her, etc.) she became flustered. The agent then kept threatening her with 5 years in prison if she was lying and just kept on until my wife said "I am withdrawing my application", "I did not know about all of this pressure".

The day after, my wife faxed a letter to the INS stating that she and I had been separated for the past 3 months because of a fall out we'd had when she believed herself to be pregnant and I mentioned to her that now is not the right time for a baby. She went on to explain that was the reason some of our recent answers were not matching and that our marriage is real even though she has fallen out of love with me due to the "baby" conflict but that we were once very much in love (she asked how does it work when relationships change within the time line of immigration process)?

The UCIS promptly sent me a denial letter to my I-485 application and advised me to leave the country ASAP. They also sent my wife a letter stating that she cannot REVOKE her withdrawal of the I-485. Both letters state that we can pay $615 and file an I-290b (Notice of Appeal or Motion).

I love my job and am struggling to make things right with my wife, but she is willing to go back (with a lawyer present on our behalf) and try to make this right. But our question to you is do we have a leg to stand on. What NEW information can we refer to to make this go in our favor and allow me to stay, work and get things right with my wife?

    Please advise,
    Nayjay
