I want to know what is the current immigration status of my family in the following given situation
I filed for my H1 extension sometime in May 2007 but mistake at my part I didn't file for my wife's and son's H4 extension. Their H4 was valid till Dec 2007. In between this period I also filed for 485 for myself and my family in Aug 2007. We visited to India last year but didn't go for H4 stamping. We all used APs to enter into US.
My wife has EAD valid till Sep 2011 and her AP expired in Jan 2010. I didn't renew my son's EAD since 2008 as he is under age to work and AP expired in Jan 2010.
I am in process of extending my H1 again but could not extend H4s for my family.
Given in this scenario what is current status of my family, is it legal for them to stay in US? I heard of few cases where 485 denied because of expired H4 and this make me worried about my family status?
