Hello there!
My husband has a greencard and a job offer to work in the States. He is staying with the same company, so an L1/2 would be arranged if he was not a greencard holder.
He can not apply for citizenship yet because he spent too much time outside the US.
The company lawyer said my husband could petition me (but that would take up to 5 years, and I have no right to stay with my husband during that time). I could visit the US on the Visa Waiver Program, but must always leave within 90 days, without garantee to get back in.
How often is this possible? (ie how often can this VWP be repeated per year...?)
Lawyer also suggested to try to go for an F1 or H1, since I have a degree in psychology from a major European University. But it is quite difficult to find vacancies in my area of expertise.
Should my husband give up his greencard, and then let the company sort out the L-visa for both of us?
We have been married since May 2005. What is the best way to be able to live together in the US for about the next 3 years?
