    B) WAIT AND FILE FOR SB1.

PLESE CHOOSE A OR B. PLEASE REPLY SIR.
    Hello Parth,

Were your parents able to return to the United States? My parents are in a similar situation and we have booked their US tickets without SB-1 visa. If they were able to fly back, were there any issues at India airport/airlines?

        Hello Parth and Aviator,

We are in a similar situation and booked US tickets for August. Could you please let us know if your parents already traveled to US? If so, what was the action taken at port of entry?

        Thanks

I really appreciate your opinion and I would completely rely on it. One last time, please do u suggest/give your opinion should I take risk for my parents, considering all that phone calls. One of the reason I am over thinking is also because this is with my parents. I don't want the situation where I get to stay in US and my parents denied.

Have u ever seen anyone anytime in the past where without SB1 visa , under special circumstances, certain post expired reenrey permit holders allowed n USA?

          thanks again sir.
Hi can you please give me email address for USA embassy in New delhi and/or Mumbai for sending them similar query. Thanks

Hi Aviator, were your parents able to return to USA? Have they faced any trouble at port of entry in US or while boarding flight in India?

Following up on this thread for anyone who has actually travelled? Any updates on what you ended up doing? Parth Green card holder PRRE2085

My father is in the same boat - he is in India and his 1 year duration outside of US ended in May. He had a flight booked originally for April to return back to US but was unable to do so because of Singapore Airlines cancelling his flights.

His green card is still valid but he has not been back to US in the past year.

Recently, a family was denied boarding by Air India. Their re-entry permits were expired, but had active green cards. They had to cancel their tickets then and there, and had returned home. Not sure how to convince airlines and Immigration officers in India

Why did they show re-entry permits when they had a valid greencard.
Re-Entry permits should have been shown to CBP upon arrival with an explanation on the delay to return being due to covid.

They were specifically asked for how long their stay in India was. In addition to that, airline agent was double checking that with the last entry stamp in passport. Not just Airline agents, this question was asked by Immigration officials as well at Delhi airport.

To everyone who has been asking, my parents just returned to the US via Newark airport after being out of the country for 14 months. They returned without an SB1 visa or a re-entry permit. They did have a flight reservation for a few months ago though which got cancelled so they did intend to return to the US within a year but given their age and flight availability, they couldn’t return sooner. The immigration officers didn’t really ask any questions. Air India at Mumbai airport also only checked their green card validity and let them board, they didn’t check any stamps in the passport. Wishing everybody good luck and safe travels!

See my previous post, if he’s wanting to travel, he can travel now on a VBM flight without an SB1 visa or a re-entry permit. He should carry a copy of his cancelled flight reservation to show to airline/immigration that he intended to return sooner but the situation was beyond his control.
