Need help Re-entry visa

Last time i was in the US was 2007 where in my Trip back to the US at the port entry all my docs got confiscated by the officer and filed a case to get my GC back and the judge approved and my re-entry visa and now 2012 i want to go back to the US again to stay. My lawyer said that he will take care of my SB- 1 visa and he will get back to me.
now i want to know since I won the case last 2007 and the judge asked me to file SB-1 which my lawyer never filed can i still get it back?
