  • H-1B + Misdemeanor

    Hello all,

I have a slightly complicated case. I was in the US for the past 8 years on an H-4 visa. I applied for an F-1 before I turned 21 to stay in status, which got denied due to the "intent to immigrate" issue brought about due to my family's unsuccessful attempt to get a Green Card through H-1B Sponsorship.

Fortunately, I finished my graduation requirements in time and had an employer sponsor me for my H-1B. Following my application I came to the UK a month ago to avoid overstaying my visa.

I did receive a Misdemeanor for Possession of False Identification (not intentional on my part, but it was not legal according to regulations) last November. I appeared in Court, plead guilty, attended the required class, got the Case Dismissed. I was Finger-printed and I provided DNA samples.

I am currently in the UK (London, to be more specific: I am a British citizen) and have an approved H-1B Petition from a US Employer.

My question is 1. What documents should I take with me in regards to the Case and the Dismissal for the Interview? (Are there any specific documents that should be taken besides the ones showing the case and the Dismissal status?)

    2. How do you think it would affect my case? (I know there are other issues that can go against me as well. But for now, those issues notwithstanding, how do you think this Dismissal will affect me?) -- Should I be bracing myself for a Denial for Stamping at the London Consulate?

    3. If I do get it stamped, what are the odds of me having major issues at the Port of Entry?

    Thank you in advance.
