Hi All,
Could someone please clarify whether it's possible to initiate EB1 through previous employer? Case details -
I was with Company A in India in a managerial position from May'08 to Sept'09 (for more than one year) and moved to US on L1-A visa in Oct'09. I moved back to India in Mar'11 and joined company B. Company B sponsored my H1 and I moved back to US again in July'13.
Company B is ready to initiate GC under EB2 (unfortunately they are not agreeing for EB1). In the meanwhile, Company A has reached out and ready to hire me at onsite. They are also ready to file GC under EB1 if it's possible.
Can someone please clarify - In order to file GC under EB1, does it require that employee continues to work with same company after moving to US? Or can I leverage managerial overseas experience while working with company A in 2008-09?
