Information: Filing Employment based GC in EB2 or EB3.
I have a few general questions which I am having a hard time getting answers for through the lawyers of my employer. I would appreciate it if accurate answers are provided by members here.
As far as I-485 is everyone( EB2 OR 3) in the same queue, or do wait times differ based on state of filing?
1. Does Labor, 1-140 and 1-485 get processed faster or slower depending on the State of residence or client. My client and one of the employer branch is located in Idaho, would either of the 3 steps be done faster because of that? If yes, would this apply to all three steps or just few exclusive ones?
2. I know that I can file I-140 using premium processing. Can the same thing be done for Labor and I-485?
3. If my Labor and 1-140 gets approved, and my employer changes, will I have to start my GC process from scratch? Or if my employer stays the same, but my client location, or employer office branch changes, will my labor have to start again? Basically I want to know how flexible are Labor and 1-140 as far as transfers.
4. I am in the 4th year of H1B, it is going to expire in 04/2010. How late can my employer apply for H1B renewal? If my H1 renewal application remains pending even after 04/2010, does it mean I have to leave the country to avoid illegal stay in the US?
