My employer wants to apply for my I-140 under EB2 category 9Exceptional ability in arts, sciences and business). My occupation falls under those categories and I have atleast 3 documents to provide (from the list of 6 given in the USCIS website) to support my application. However, my immigration attorney thinks that it is a bad idea and is suggesting to just apply under EB3. He is also unsure about the exact requirements for EB-2 under this category and thinks that it has a much lower chance of getting approved. Can I apply in EB3 for now and then afterwards apply separately for EB-2 under this category? I have not read about this special category anywhere in the forums and was wondering if anyone can provide any information on this.
Also, if an I-140 petition gets denied, can I use the same PERM to apply again?
