~~ Applying I-140 under EB1 with H1B to L1A COS ~~

Hi

I am currently on H1B. My visa is expiring in 3 months when I will be completing 6 years in US. My company is applying for H1B to L1A COS to make use for the 7th year allowed on L1A.

Can they apply for GC - I-140 while my COS is in progress or will they have to wait for COS approval?
