  • Help with answering questions on new I-130 & I-485 dated 02/27/17 & 01/17/17

The new I-130 & I-485 have some questions that are not clear:

    I-130
    - Part 1, item 2. I am applying for my mother. What should i fill in here. The check boxes only make sense for a child, but it says i should check one for a parent also?
    - Part 2, item 40 & 41, Do i have to fill this in if i am a citizen?
    - Part 4, item 57 and 58. Should the address be to USA or abroad?
    - Part 4, item 61. Should this list the office location that we will send the application?

    I-485
    - Part 2, what checkbox should i choose for sponsoring my mother with a concurrent filing of I-130 and I-485? Some people say A and some say H.

    Thanks

Yes. You check one based on the situation with you being the child and your parent being the parent.

    no

57 is the beneficiary's name (Part 4 #4) in a native script if it is a non-Latin script. 58 is the beneficiary's address (Part 4 #11) in a native script if it is in a non-Latin script. Since they are doing AOS, their address (Part 4 #11) should be in the US, and thus it is not in a non-Latin script. So 58 should be N/A.

You put the USCIS local office with jurisdiction over your address. The application will always be mailed to the Chicago Lockbox.

    A

This is my personal opinion and is not to be construed as legal advice.

        I-130 Part 4 Item 8

Hope everyone here is successfully completing their forms.

I am, on the other hand, unsure on how to answer I130 Part 4 Item 58, when trying to sponsor my spouse. Is the point of the question to get spouse's address in her country of citizenship? Or country of current residency?

My wife is living and working in the UAE right now. She plans to return to her country of citizenship/birth in a few months. None of these countries use English as their native language (although addresses in English are recognized).

If I take the directions literally, I would put her current UAE address in her native language (Bangla/Bengali) (which no one in the UAE would recognize).

        Someone PLEASE HELP !!!
