My folks visit me every year from past 5-6 years during summer on tourist visa and stay for 5-6 months. They are old and winter season does not work for them from health perspective. The tickets for next summer June 2019 with return in Sep 2019 is already booked.
While they are here can I file for I130. The reason I want to do this is to time it correctly. I fear if I apply once they return, they won?t get it approved in time for next summer and won?t be able to come back in summer 2020. Even if they get approved the plan to go back in August 2019 won?t change since they will be visiting few other countries on the way back to home country.
I understand the B2 visa intent is not to immigrate and for the next trip they will go back to home country as intended. I just want to optimize my time for next travel for them. Do you see any concern with this ? or have any suggestions ?
