  • Need advise on immigration for minor brother in-law

    My wife had become USA Citizen few months back and she has sponsered (I-130) my mother in-law for immigration from India to USA. Her case is moving along fine as already got $380 Bill for Immigration Visa Processing Fee.

    My brother in-law who is 17 years old is finishing his high school in India this May'07. We're looking for an advise on what is the best way to bring him to USA at the earliest. Based on our limited knowledge, we're evaluating following options:


    1. My wife files I-130 for him (as Sibeling) but i guess this may take several years, as current priority date is 1995, right? --- Or --

    2. Once my mother in-law comes to USA on immigration visa, she can sponser him. I believe in this my brother in-law case will fall into Family 2A category where priority date for India is 03-22-02, right? So the questions are

    a. If my brother in-law doesn’t get Visa in next 4 years (when he turns 21), would his case be pushed to Family 2B category?

    b. My mother in-law may not stay in USA for more than month or two per year. She will visit every year for her green card renewal while my brother in-law is still in India. Does this impact my brother in-law’s case or eligbility for sponsership?

    3. How difficult it is to get a student visa for undergraduate courses? What are the big downsides of coming on a student visa for undergraduate study compare to immigration visa?

    4. Any other options that you suggest fit the case best?
