  • Marriage based Green Card

    Hi,
I am currently on a H-1B work visa and have now married a US citizen. I wish to apply for a Green card based on my marriage and have a few questions regarding the supporting documents required for filing the I-130 form:

    1. First up a general question: We are officially married (have a marriage certificate as proof) but my wife hasn't changed her last name yet on her passport. Do we need to change her last name to my last name in order to apply for the family based green card?

    2. Required document:
Copy of your naturalization certificate or certificate of citizenship issued by USCIS or the former INS.
Question: My wife got her citizenship through her parents (i.e. she is a naturalized citizen). Can the naturalization certificate of her parents work? Is there any alternate document that can be used instead? Can we obtain it NOW from a US embassy?

    3. Required document:
Copy of Form FS-240, Report of Birth Abroad of a Citizen of the United States, issued by a U.S. Embassy or consulate.
    Question:
Can we obtain this documentation NOW from a US embassy or consulate?

    4. Required document:
Original statement from a U.S. consular officer verifying that you are a U.S. citizen with a valid passport.
    Question:
Can I obtain this from my local US consulate?

Any help/pointers regarding this would be helpful. Thanks
