My Perm was filed(say employer A) on 15th April, 2013
Went to Audit around Dec end 2013 and still waiting for approval.
My H1B is expiring on 15th Aug 2014.
I am currently in India and have stayed out for more than 1 year outside US.
I wanted to know if I am going to US (say after 3-4 months) on L2 visa ( as my wife is on L1A and considering that my H1 expires) and join a new company(B) and start working with them on L2 EAD. If they file perm for me and later I140, and if both of them gets approved, can they use my H1B ( expired on Aug 2014) and get 3 year extension based on that H1B and will I be able to move to H1B from L2 without moving out of US?
