  • Wife's Visa Denied at Consulate Juarez

Good evening everybody. I am a new member here, but I have been reading these boards for quite some time. I am looking for some help and guidance. Last week my wife and I traveled to Juarez for my wife's interview. I feel like our lawyer did not properly prepare us for the interview. My wife's visa was denied based on how she entered the US almost 12 years ago.

    Here is what happened:

On July 21st, my wife attended her interview at the consulate for visa approval. During her interview my wife was asked about 6 questions and then denied a visa based on an allegation that my wife willfully lied and misrepresented herself. The consular officer stated section 212(a)(6)(C)(i) and Section 212(a)(9)(B) of the Immigration and Nationality Act as the reasons for denial.

I believe that from what my wife told me, this officer was impatient and not willing to dig deeper into my wife's statements. The officer asked my wife how she crossed the border back in 2003. She told him that she borrowed someone's id and just walked across without being inspected. No fingerprints were taken, no questions were asked and she was not searched. She just walked across the border. There was only two guards at the time standing there just waving people through. So there is no record of her crossing the border. She entered without inspection. We told this to our lawyer, and he put down that she was EWI when we filed the I-601A. My wife did not willfully lie. She has told the truth throughout the entire process.

I really need some help. I'm not sure if my lawyer can get us out of this. I need my wife, and my children need their mother.

My 5 month old needs to stay here in the states since he is receiving specialized care for plagiocephaly in Fort Worth. He is also still breastfeeding and will not be able to continue without his mother.

I understand that coming across the border using a citizen's ID is a fairly serious offense.

We were told by the consular officer that our case is still pending and that we need to submit the I-601. We had previously filed the I-601A and it was approved.

Our lawyer will be filing the I-601 this week. I also got some help from a congressman who will help us try to expedite our case.

What are our chances of getting this case expedited and approved?
