H1 Transfer without 797 and H4 copies
Hi, Need help to understand my situation.
Recently I transferred my H1 to company B in USA, On approval of the notice joined the company B almost month later. Now due to some personal reasons I want to join company C and planning to transfer H1b to company C.
Issue is:
Now I am in company B from last 2 months. But still now I didn't received my I-797 and dependents H4 copies. Company saying that they didn't received the copy from USCIS and need to apply 824 for duplicate copy, which will take almost 3-6 months time and I don't have any other proof other than petition number ( WAC#). And I have all other required copies other than 797.
Can I transfer my H1b from Company B to Company C with out 797 copy ?
Is there any problem in H1b Status if I try to transfer visa like this?
Note: I had My Company A , 797 and I94 Copies which are valid still June 2016.
