My H1B max out date is Feb 13th 2020 ( including recapture period). My H1B extension was filed in regular processing in December 1st week 2019 requesting the recapture period and it is in progress. My perm got approved in January and we have filed for I-140 under premium processing and received RFE today. We will be responding to it next week. My question here is:
Since my max out date is approaching, can i stay here with H1B extension receipt and wait for my I-140 approval and apply H1B extension?
Please share your ideas regarding my scenario, it will be really helpful.
