Hi All,
I am trying to apply OCI for my 3 month old baby. Indian Parents (H1/H4). Both of our visa expired on 2021, but have a valid I-797A until 2024. Also received 485-EAD/AP as well, valid until 2023. Which one should we use for legal status ? Read comments that folks at embassy may not accept expired visa. Can we use only 485 EAD/AP as valid status without any 797 or Visa related to H1/H4.
