  • L1 to GC

    Hi,
My L1 gets expired by nov 16 mid this yr. Have i94 till 2015, but have to make an emergency india trip in march 2013 for a month. Company has agreed to process GC. How much time it may take. If i go to india, do i need a valid visa to come back, even as GC process has begun?

I think you meant March 2014.

Is your visa L1A or L1B? If you are on L1A GC can be filed under EB1 and if everything goes fine you can get GC in a Year.

If filed under EB2 can take around 5-7 Years. If filed under EB3 can take over 10 years as per current wait time.

If you leave US, you would have to return the existing I-94. And if you and are planning to return after 16 Nov 2013, Yes, you would need a new visa to come back, even if GC process has begun.

This is my opinion not legal advice.
