EB5 still marked as "U" in the March VB

  • EB5 still marked as "U" in the March VB

    The March visa bulletin was out few hours ago, and it unfortunately stated EB5 as "U" again. My family and I are currently waiting on an interview date after our documents were accepted on Feb 1. Does this mean we won't be getting an interview date before April even though Trump signed the bill today?

    Employment Fifth Preference Categories (I5 and R5):
    The continuing resolution signed on January 25, 2019 extended this immigrant investor pilot program until February 15, 2019. The I5 and R5 visas may be issued until close of business on February 15, 2019, and may be issued for the full validity period. No I5 or R5 visas may be issued overseas, or final action taken on adjustment of status cases, after February 15, 2019.
    The final action dates for the I5 and R5 categories have been listed as ?Unavailable? for March. If there is legislative action extending them for FY-2019, the final action dates would immediately become ?Current? for March for all countries except China- mainland born I5 and R5 which would be subject to a September 8, 2014 final action date and Vietnam, which would be subject to a July 15, 2016 final action date.
    In theory, your category is C and because it was signed it will turn to C for March.

    The problem is what USCIS put on their site: https://www.uscis.govhttps://www.imm...sas-march-2019

    There is no mention about U changing to C. So maybe the person with your file will not see it C until April. I hope I'm wrong and you get your GC soon.

    The good news is that the next date will be September 30th, that means that April thru September your category will say C.

        Yes, that should be it. The problem is that I couldn't find the same legend on USCIS site. So they may or may not follow what is said by the other agency.

        Anyway, good luck, I hope you get it soon but plan for a few more months.
