Hello All,
I am a H1B visa holder working here for approximately 2 years. We are in a weird situation and need some advice.
My wife is a J1 Visa Holder who completed her Masters in her filed in October 2012. She has also been working for the past year in her company. She has her J1 visa valid until April 2013.
We got married here in the US in June 2012 and have the valid Marriage Certificate.
Query 1):
Her visa does not have the 2 year Residency requirement stamped on it. Does this mean she doesn't need to go back to our home country for 2 years?
Query2)
Her company is applying for her H1B visa and will do so in March of this year. Is is possible for her to transfer to H4-B until her H1B petition is approved?
If so what are the steps and procedures? Can someone please advice on how to go about this?
