Hi,
I am in a unique situation.
Currently employed with emp A. Going India for visa stamping. Have my PD Aug 10 and 140 is approved from emp A.
Scenario 1) Once I come back, I would like to work for emp B. If my employer A agrees for not to cancel my current GC petition then do I need to file with emp B as my petition is pending and I don't mind working back again when i get my green card for some time. Is it legal or feasible?
Scenario 2) I hear lot of stories from H1 holder brothers that at consulate they have started giving unnecessary hard time, and if unfortunately they don't let me enter US and I get stuck at home country. Now, I am going to file brand new H1B from emp B in Apr 2014 then will I be able to keep my PD, I140 and GC application active even though I have a gap in which I am not in USA?
