I had an employer who has filed my H1-B transfer and got placed to the their new job. When my H1B petition got approved, I got the I-797 B instead of I-797 A. I understand, that when you have the I-797 B, that means that your petition is approved but not your change of status.
But, I did not go to my home country for stamping to get my status corrected and worked for 6 months. Now, the situation is that I have to travel India for family funtion in June 2013.
Question is: Can I work with I 797 B petition in US (without stamping, since I 797 B means change of status not approved and it doesnt have an I94)? Will it create any issue in my stamping ? If yes, what is the next step, which I should fix before going to stamping.
