H-1B extension, 2nd RFE, Role missmatch - Help required
My H1B was expiring on Sep 30 2013, my employer (Tier-1, BEP enabled) applied the extension on Sep 16 2013 in premium. My original petition was for the role of 'Programmer Analyst' hence my employer applied the extension for the same role.
We received first RFE on Oct 1st asking for SOW, pay stubs, invite letter and Experience letters as prrof for employee-employer relationship. My employer submitted all the documents., after submitting the documents received 2nd RFE on Oct 24th.
We have now received a second RFE on the petition where in USCIS has stated that the SOW provided as part of the RFE does not specify the designation that the beneficiary has applied for. The extension was applied for the role of “Programmer Analyst” and my employers latest SOW does not specify any requirement of a programmer analyst in the SOW.
Need help your on next steps to strengthen this case.
