Hi.
I am currently on L1 valid till jan 2016 for company A
I want to move to H1 with in same company.
I had H1 from 2005 till 2008 and 2010 till 2012 (but been in usa only for 1.3 years H1+L1 combined) so i know that i can claim cap exempt under remainder option (6-1.3 years)
The question is my company would not do a COS . but they might do consular processing.
The question is does start date of H1 petition and approval date of it matter in this case. I know it matters a lot in COS between two different companies. but with in the same company does start date and petition approval date matter at all in l1 to h1 ?
