Hello ,
I had H1B petition approved in May 2008 and it expired in Aug 2011. It was never stamped and never used.
After that I traveled to US on L1B visa on Sept 2011 and I am in US since then. Both the L1b and H1b were under same company.
Now Can my old H1b be utilized now under no cap or cap exempted as six years is already ended last month.
If yes , 1. are the chances for getting approval under no cap after the 6 year relatively low?
2. Since I am on L1b now, should it be a conversion to H1b?
3. How long can I stay if I get the H1b . I came to US on Sept 2011.
4. If a different employer process my H1b under no cap and its gets rejected , can I still continue to work with my current employer with L1b visa.
