My husband is on H1 B and his overall stay in US has been 4 years (2006-2009 and now from Sep 2014 till date). After marriage I have joined him on H4 from Oct 2014. Please suggest the best way of filing tax returns in order to get the best tax benefits.
Should he apply for my ITIN first and then file jointly ? Or he can file alone mentioning his status as married without my ITIN and avail the same benefit?
Is it possible to file as "Married filing jointly" without H4 spouse's ITIN?
Please advise.
