I129 denied for the expired H1-B

Dear Friends,

I need your suggestions and help on following..

I had a stamped H1-B valid till Jan-2015 which i never traveled to US and my company applied for exempt/extension in the month of Feb-2015 in Premium Process,
Initially we got RFE and after responding to it today the case says 'we denied your Form I129', we are waiting the email instructions..

I think technically i have no status..

1. What could be the other options that i can seek at this moment?
2. Extension can be re applied for the same Cap or i lost the CAP?
