Dear All,
I am looking for help on how to replace current h2b workers that resign before their status expires.
I have a valid LCA but some of the workers have resigned and gone back to their home countries which leaves me with their work to cover. The DOL state that I should use the current certified LCA and re apply to USCIS with new workers to replace the old workers. Is there any guidance on this and would the new workers be subject to the cap?
