I worked in US on multiple assignments during my both H1B Stamping (Oct2005-Sep2007 and Oct2008-Sep2010). However collectivly I spent only 3.5 years in US on this H1B.
After this I again went to US for another 3.5 years(2011-2014) on L1B. There is no plan to extend L1B.
No GC process was initiated during any above stay. In all I stayed in US for 7 years (H1B+L1B). I am outside US now sine last 9 months.
Can my new company file under H1B cap-exempt now? {Confusion is I was staying in US(on L1B) after my H1B expired. And also, I stayed in 7 years in all.}
Please guide.
