H1 in process, stamping pending, l2 stamped

    Hi,

    My situation is below :-

    My husband is in US on l1 visa. And my l2 dependent visa is approved and stamped.
    My employer has processed my h1 visa as well. And it is approved but I have not gone for visa stamping.

    So my question is:-
    If I go for h1 stamping, will there be any problem with my l2 visa.?
    Is there any possibility that my l2 will be rejected or declined since my h1 is stamped.
    If l2 is not rejected and if I have both h1 and l2 what process needs to be followed to come to us on l2 status?

    Appreciate any help!!

    >>> L2 will most likely be cancelled when you go for H1B stamping.

    >>> You already got the L2 visa approved. So there cannot be a rejection or denial. But the previously approved visa may get cancelled.

    If l2 is not rejected and if I have both h1 and l2 what process needs to be followed to come to us on l2 status?
    >>> Highly unlikely. You will have only one valid visa in the passport. In case they let you have H1B as well L2, then you have to show the right visa at the POE when you enter U.S. If you want to enter in L2 status, then show L2 visa. If you want to enter in H1B status and begin working immediately, then show the H1B visa at the POE. If you enter in H1B, you should be working and getting paid to maintain the H1B status.
