I have few questions regarding recent status change from F1 to H1B. Please help me with your experience and/or thoughts.
Here is my scenario, I was a F1 student and completed MBA and completed OPT by end of March 2015. Then my employer applied for my H1B and same time I have joined in another university for MSCIS. Class was started in April 06, 2015. Escalated the H1B process to Premium Processing and got approval on October 09,2015. But validity was started from October 01,2015 till September 30,2016.
I haven't received any information regarding my status change until October 09,2015. I have contacted Attorney on October 05,2015 and attorney said to wait 7-12 days. During this time my husband traveled to US and homeland security stopped him and told that, my (Principal Applicant) status has changed on October 05,2015. After all detail checking, the homeland security couldn't find any bad issues on our history/stay in US. So they canceled his F2 visa and send him back to India. I have explained to the Homeland security officer that, we haven't hear any status update from Attorney or the USCIS website. Also mentioned about the Premium processing. He said to me that, I need to contact my school and change from Full time to part time. He already talked to my university just before that. The very next day on October 09, 2015, attorney received the email confirmation from USCIS saying my H1B approved. Then I have changed my full time student to part time student.
Here is my problem,
Then 2 weeks later, I have requested H4 documents of my daughter (who is with me) from attorney . But they said my H1B approved without I-94,which means I am unable to change my status in US and my daughter should get stamped in India along with us. No H4 approval for her. Is it correct? But the email received from USCIS was mentioned I-94 number in it. I have traveled to India during my OPT and come back after 4 weeks but the school didn't update that on my SEVIS. I believe that, that could be the reason for the H1B approval without COS.
Should I go immediately to India for stamping? or if I go after 2 months any issue?
My attorney said still I am on F1 status, then why they deported my husband? If I am still on F1 I should be a full time student, and I am unable to add or drop any course right now. Is there any problem to continue with part time for this quarter?
I suppose to go to Chennai US consulate. Bit worried about what will the impact of deportation of my husband from US (Homeland security said, they couldn't find any fault/tread on our case. so my husband can comeback as soon as he get the H4visa on his passport.
