in October 2004, i transferred my H1, but the lawyer did not file the H4 for my wife. last year when i transferred my visa again, the other lawyer also did not file for H4. I was under the assumption that my wifes legal presence depended on my legal H1.
Recently i was applying for the 7th year extensioc (as my LC and I-140) have been approved) my lawyer now told me that my wife is out of status for more than 1 year and will be barred from entering US for 10 years.
This means I would have to leave my job and return to india with her. Do I have any options, pay fines, apply another visa. or appeal in order to ensure she stays with me in the US.
Can you please tell me the options I have.
