When to Apply for H-1B (expired)

Hi,
I had H1b Stamping in 2012. and expired in Sept, 2015.
I came to India in Feb, 2015.
Now I want to apply for the H-1B (renewal) again.

Can I be cap exampt candidate?
If so, when can I apply for the H1B?(Any time or only after April cap quota)

Please let me know What are all possible ways for me.

Do you have the copy of the I1797? Do you have an employer who is willing to petition for you?

Do You mean I-797 Copy(last h1b copy)? Yes
No, still looking for an employer who can do petition.
But want to know whether i(my employer) can apply for h1b any time (in a year) or after april ?
